I was tricked and got fired

I made a previous post a month ago about my job I just started. Well this week on Monday I got a call from the assistant manager that I was getting laid off because the season is slowing down. I was ok with that, and in addition told me since it's slow that I didn't need to come in on Tuesday. Fine again I thought, I'll start looking for a job. Then Wednesday comes around and I get a call from the manager telling me I was terminated for not showing up to work on Tuesday. I tried telling her I was laid off by her assistant but she wouldn't listen. I think I was tricked into getting fired and they had it out for me obviously. My feelings were hurt. And because of this "trick" they pulled I am unable to claim unemployment as well. I'm furious.

Well that's not legal at all. If that's the entire truth, you should talk to a lawyer. The phone company will have records that the call took place and that they initiated it.

Holy sh*t dude, your assistant manager is an asshat. Go get their asses for that. That's like entrapment (isn't it?).

Well I knew from the first day that the respect towards me at that place was less than hospitable. It got worse and worse when they would keep criticizing me for things I was doing right. They kept telling me I was screwing up and I'm like "I'm not". There were things they would criticize me for when they wouldn't even show me how to do them. Constantly. I was only there for four weekends. The snide remarks about me behind my back. I felt like they were trying to push me out and when I didn't budge they went ahead and did this on me. I legitimately felt like I was being treated differently from everyone else. I don't' want to say it's because it's an all female environment also and I never said anything rude about anyone nor have I ever disrespected anyone at that place either but it really felt like they didn't want me there even though I was doing my job. This underhanded tactic they just pulled this week idk if I can even prove it. But now I am out of a job and unable to claim unemployment because they are just going to go ahead and say I was fired for not showing up to work on tuesday when I clearly got a call on monday saying I was laid off because of the "slow season" and then to call and say they were terminating my position on wednesday because I didn't show up on tuesday when SHE **** SAID I DIDN'T EVEN NEED TO COME IN!

Like AI said, the phone company will have records proving what you're claiming is true. It's worth at least speaking to a lawyer to see if there's a way to get what they owe you.

One thing though, say he does get a hand on the record that the call was made from the assistant manager - how would they argue against it? Could you even request a recording or something? Just walk up to NSA and be like "Hey so, out of all your recordings do you think you could make a copy of this VERY specific one for me--"

In all seriousness though, a lawyer would probably know better about that than me, but I was just thinking ahead. I assume your assistant manager didn't contact you frequently, if ever?

She was very sketchy on Monday. She started off saying "Oh you left before the manager talked to us about it so I'm calling you to tell you this". A lot of people left on the same time I did on Sunday so for me to be the only one not there seemed odd to me too. I don't really care for legal recourse since it's not my future anyway. But I will damn make sure that this small town knows about their scuzzy reputation. Karma's a bitch and will bite them in the ass and I'm happy knowing I'm a better person than they are.

I do have two brothers who are lawyers. One in Virginia and one in New York. I'll ask and see if they'd know anything. My feelings are hurt more than anything. I've never really had anything like that happen to me.

To be entirely rational about it, you should at least pursue legal action so they are shown that they can't walk all over people like that.

That's beat, that kind of stuff can throw you off track, if you have 2 lawyers in your circle you should tap into it. Years back, I had some unfortunate circumstances that led to me in living in my car for awhile, only to end up getting fired from Planet Fitness in a similar situation. Wish I had pursued it, would have made that following years a little easier :bitnaughty:

I went ahead and called one of my brothers who said it was indeed entrapment and can be considered fraud since this isn't a fire at will state. I wrote a letter to the owners of the hotel complex (it's a bunch of investors) and they apologized and said they are going to look into the matter. I'm surprised taking action actually did something and that someone took my side from that place. In the meantime I am able to work per diem at my mom's hospital as a CRT. I still had one of my credentials and they felt bad about my position. Things work out for the better when I speak up I found out. I still need to take my RRT if I want this position to be permanent but 35 dollars an hour isn't bad at all. My life is a lot better today than it was earlier this week. Even better than the beginning of october for that matter. I'm an educated individual with a loving family and the personality that makes people feel nice around them. I've grown up the past 14 years and I am not who I was before I attended college. That much is true.

I know the feeling. Something similar happened to me once. Except, they waited until right after I had just got done putting in extra time to tell me I was fired. The guy in charge was later arrested for public intoxication which also led to finding heroin on him(or something like that). It would have been funny, but at that point I did not care because it had been about 3 years. The manager in question was the boss of the whole operation out here and not just one of the sub-managers, and he moved from Virginia to take the job. He knew the company's owner personally, and apparently had been trusted to run their little operation here.

In this case I would not demand much. Just that the manager be ordered to commit seppuku by the nebulous group of owners, and that it be put on record as a case of fraud.

I'm glad things seem to be working themselves out!

But yeah, definitely don't be afraid to speak out/stand up for yourself...the worst that can happen is that nothing changes.

I think I'm gonna end up leaving New England altogether. My new workplace has this boss that's been calling me a "gypsy" over and over again. For those who don't know, it's a slang racist term. I'm not a gypsy. He uses it to tell you that you are "lazy". I get told I'm a gypsy all the time in front of people.

^ Seems like you may be stretching what that means. I always thought it was a race of people, but it has a secondary definition; a free-spirited person.

^It's contextual. I've heard it used in place of "Jew" or something similar to denote someone as lazy or thieving or greedy.

Haaa. Old-school Europeans will only ever mean something highly offensive when using "gypsy". I'm sure that carries over very easily to other places influenced by that culture.
